MUNICIPAL MEETING ROOM

MARCH 3, 2003

 

 

Chairman Braun called to order the regular meeting of the Wall Township Planning Board at 7:30 P.M.  Members present were Braun, Thomson, Brosnan, Morris, Luttman, Farrell, Wilson, Kiley, Attorney Rubino, Attorney Hirsch, Engineer Gerken, Planner Bergailo, Traffic Engineer Oltman, Planning Board Secretary Lang, Recording Secretary Betty Schinestuhl and Court Reporter Arnone.

 

Chairman Braun announced the meeting was being held in accordance with the “Sunshine Law” and a resolution adopted on January 13, 2003.

CARRIED APPLICATIONS

 

ROBERT JOST – PB#16-2002 – 1623 Marconi Road and 1600 Wright Street, Block 113, Lots 12 & 14, R-15 zone.  Applicant seeks an extension of time.  Minor subdivision with no variances.

 

Granville Magee, Esq. appeared for the applicant.

 

Ms. Wilson stepped down on this application.

 

Attorney Magee said the applicant is seeking an extension of time.  The original approval was August 2002.  There were no variances needed.  The new owner is designing the house and needs an additional 10’.  We are moving the lot lines 10’.

Attorney Magee said all the applicant did to amend this was move the westerly lot line 10’. 

 

Chairman Braun asked if the applicant can comply with Mr. Gerken’s letter of February 24, 2003.  Attorney Magee said he has reviewed the letter and can meet all conditions. 

 

Mr. Kiley moved to approve the application subject to the applicant comply with the review letter of Mr. Gerken dated February 24, 2003.  Deputy Mayor Thomson seconded the motion which

was unanimously approved by a roll call vote.  (Messrs. Kiley, Thomson, Brosnan, Farrell, Luttman, Morris and Braun voted yes.

 

Ms. Wilson returned to the meeting.

 

CHRISTOPHER STEPHEN ENTERPRISES - PB#23-2001 – Highway 34 and Holly Boulevard, Block 845, Lot 31, OP-10 zone.  Application deemed complete: June 5, 2001, amended March 11, 2002.  Carried from August 27, 2001, February 25, 2002, March 11, 2002, April 29, 2002, September 9, 2002, November 25, 2002 and January 27, 2003.

 

John Giunco, Esq. appeared for the applicant.

 

Kenneth Wondrack and Tom Ross asked to be heard.  Mr. Ross stated Attorney Mancuso, who represents the Homeowners Association, had an emergency and will not be here this evening.  He asked if this application can be carried.  Mr. Ross said Attorney Mancuso had questions for the applicant’s witnesses. 

 

Attorney Giunco said his client wants everyone to have the opportunity to be heard but we also want this to come to an end. 

 

Attorney Rubino said we can proceed with testimony tonight but not call for a vote.  We can carry the vote to next week. 

 

Attorney Giunco said he is booked for March 10th, but he would send another attorney from his firm.  Attorney Giunco said they can proceed with testimony and give Attorney Mancuso the opportunity to ask questions next week. 

 

Chairman Braun said we should try to proceed. 

 

Attorney Rubino said Attorney Mancuso could have a transcript of the meeting but he could not say it would be completed in time for him to review before next week. 

 

Attorney Rubino said all witnesses will be available next week and Attorney Mancuso will have the opportunity to plead his case then.  We will not open the meeting to the public tonight. 

 

Chairman Braun said if there is anybody here that is not represented by Attorney Mancuso we will hear them tonight. 

 

Attorney Rubino said Attorney Mancuso can come and listen to the tapes.

 

Chairman Braun said all testimony will be a review of prior testimony.  

 

Attorney Giunco said he wants to make sure everyone is heard. 

 

Thomas Kelly, Esq., representing himself, said his concern is that it is a mistake for the Board to

proceed.

 

Attorney Giunco said if there is any objection at all we can carry it to next week. 

 

Chairman Braun said this application is being carried to March 10, 2003.

 

Attorney Rubino said legally the Board has every legal right to proceed with this hearing tonight.  He said if the applicant wanted to proceed we would have.

 

RESOLUTION TO BE MEMORIALIZED:

Block 832, Lot 19

 

Attorney Rubino read the resolution of approval.  Ms. Wilson moved to adopt the resolution as read.  Deputy Mayor Thomson seconded the motion, which was unanimously approved by a roll call vote.  (Ms. Wilson, Messrs. Thomson, Brosnan, Kiley, Luttman and Braun voted yes.)

 

There being no further business to come before the Board, a motion was made, seconded and unanimously approved to adjourn the meeting at 8:00 P.M.
