Chairman Braun called to order the regular meeting of the Wall Township Planning Board at 7:30 P.M.  Members present were Braun, Tobia, Thomson, Brosnan, Morris, Luttman, Farrell, Wilson, Rible, Kiley, Attorney Rubino, Engineer Gerken, Planner Bergailo, Planning Board Secretary Lang, Recording Secretary Betty Schinestuhl and Court Reporter Arnone.

 

Chairman Braun announced the meeting was being held in accordance with the “Sunshine Law” and a resolution adopted on January 13, 2003.

Attorney Middleton asked if the Wilkins application could be heard first his client is not here yet.

Ms. Wilkins stated she and her husband are the owners of 3240 Ridgewood Road.  She said she has lived there for 20 years.  There is an existing dwelling, in-ground pool, detached wood deck, wood shed and driveway on the property.  She would like to subdivide the property so her son can build a house. 

 

Attorney Blasi asked Ms. Wilkins if she is planning on building a single family home with a detached garage on the property.  Ms. Wilkins said yes.

 

Attorney Blasi asked Ms. Wilkins if the plan before the Board calls for variances.  Ms. Wilkins said yes.

 

Attorney Blasi said on proposed lot 3.02 a side yard setback variance on the east side is needed.  Ms. Wilkins agreed.  Attorney Blasi asked if that was a condition that exists now.  Ms. Wilkins said yes.

 

Attorney Blasi said on proposed lot 3.01 there are variances needed.  Ms. Wilkins agreed. 

 

Attorney Blasi asked if Ms. Wilkins will meet all other ordinance requirements.  Ms. Wilkins said yes.

 

Attorney Blasi asked what you have done to eliminate the impervious coverage variance.  Ms. Wilkins said the driveway is H-shaped now and the cross area and left side area will be removed.  Attorney Blasi asked if she will meet the 5’ setback.  Ms. Wilkins said yes.  Attorney Blasi said with the removal of parts of the driveway no impervious coverage variance is needed.  Ms. Wilkins agreed.

 

Attorney Blasi stated Ms. Wilkins has been in contact with one neighbor who lives on lot 137.  Ms. Wilkins stated that is the neighbor to the rear.  He is here tonight.  She said she met with him regarding this subdivision.  Ms. Wilkins said he was concerned about the removal of all the trees on proposed lot 3.01.  She said they are going to try and leave as much buffer as possible along the perimeter.  Chairman Braun asked if the 15’ at the rear would be untouched.  Ms. Wilkins said there are evergreen trees and various other trees that will be left alone. 

 

Attorney Blasi asked if Mr. Paine had any other concerns.  Ms. Wilkins said they agreed to plant additional trees in the empty spaces.  Attorney Blasi asked if Mr. Paine was satisfied.  Ms. Wilkins said yes.  Attorney Rubino said the buffering along the rear would be a condition in the resolution.  Attorney Blasi said his client will plant an entire row of white pines or cypress.  Ms. Wilkins agreed. 

 

Attorney Blasi asked if the height of the detached garage would comply with township regulations.  Ms. Wilkins said yes.

 

Attorney Blasi asked what the width of the driveway on proposed lot 3.01 would be.  Ms. Wilkins said she did not know but it would conform to township ordinance.

Joseph Lazok was sworn.  Mr. Lazok prepared the maps. 

 

Attorney Blasi asked Mr. Lazok for the width of the driveway.  Mr. Lazok said it will be 8˝’.  He said they have room to move the house if the Board wants it wider.  Mr. Lazok said 8˝‘is reasonable.  Attorney Blasi asked if he would meet the 5’ setback.  Mr. Lazok said yes.  Chairman Braun asked if the house could be moved and make the driveway 10’ wide and still have a 5’ setback.   Mr. Lazok said yes.

 

Attorney Blasi said he agrees with the comment in Mr. Gerken’s letter under #3 miscellaneous.  He said they will revise the plans so all items are to scale.  Mr. Lazok said there is an error on the map.  He said it will be corrected.

 

Attorney Blasi said, in reference to #6 under miscellaneous in Mr. Gerken’s letter, an easement will be necessary.  Attorney Rubino said he will contact the Township Attorney and ask his opinion.

 

The application was open and closed to the public.

 

Ms. Wilson made a motion to approve the application for minor subdivision subject to payment of taxes and applicable assessments.  The applicant will comply with the requirements of Monmouth County Planning Board and Monmouth County Board of Health.  The applicant shall comply with the review letters of the Board Professionals.  The applicant will plant a single row of white pine, evergreens, Norway spruce and Leyland spruce along the rear property line.  Bulk variances are granted.  Mr. Luttman seconded the motion which was unanimously approved by a roll call vote.  (Ms. Wilson, Messrs. Luttman, Brosnan, Farrell, Morris, Rible, Thomson, Tobia and Braun voted yes.)

Attorney Middleton stated the applicant owns block 70, lot 29.  This site is located at the intersection of 5th Avenue and Meadow Road.  There are three structures on the site.  The dwellings are dilapidated and the other homes in the area are quite attractive.  The applicant is proposing to create two lots.  Two of the dwellings will be removed.  The shed will also be removed.  There will be one house on one lot and a new house on the vacant lot.  Both lots are oversized.  They are deficient in width and frontage.  The home on proposed lot 29.01 will also have some existing setback issues.

 

Mr. Campanile stated he has owned the property for 10 – 12 years.  Mr. Campanile said he no longer lives on Meadow Road.  He said he is tired of the rental business. 

 

Attorney Middleton said the three dwellings on the lot are all rented.  Mr. Campanile said yes.

 

Attorney Middleton said the two dwellings to the rear of the property will be demolished.  Mr. Campanile agreed.

 

Attorney Middleton said the vacant lot will be sold to a builder and a new house will be built.  The second lot will be sold to a buyer once the deck is removed.  Mr. Campanile agreed.

 

Chairman Braun said he is unclear about the driveway.  Attorney Middleton said the driveway seems to be the dividing line for the two lots.  Mr. Campanile agreed.  Attorney Middleton asked Mr. Campanile if he would agree to move the driveway 5’ off the property line.  Mr. Campanile said yes.  Chairman Braun said there is room for totally separate driveways.  He suggested putting them side by side.  Mr. Campanile said two driveways will be installed along the common property line.

 

Chairman Braun asked if the applicant can comply with Mr. Gerken’s review letter.  Attorney Middleton said the carport will be removed and we can comply. 

 

Mr. Gerken said the utility pole, if not needed, should be removed. 

 

Mr. Gerken said the setback for the driveway will not fit.  He said a variance for 3’ will be needed for the driveway on proposed lot 29.01.  Attorney Middleton said the north side will conform. 

 

Chairman Braun asked about water and sewer.  Mr. Gerken said they may have to be capped off.

 

Ms. Wilson asked if the driveways will be paved.  Attorney Middleton said yes. 

 

The application was open and closed to the public.

 

Mr. Tobia said the photos taken on February 3, 2003 showed the garbage around the buildings.

He said the garbage is not called for. He said part of the problem is the applicant’s lack of enforcement of cleanliness and maintenance.  Mr. Tobia suggested that as a condition of approval Mr. Campanile should be required to clean up the property within 10 days.  Mr. Campanile agreed.

 

Ms. Wilson made a motion to approve the application for minor subdivision subject to payment of taxes and applicable assessments.  The applicant will comply with requirements of Monmouth County Board of Health and Monmouth County Planning Board.  The applicant shall clean up the property within 10 days.  The applicant shall comply with review letters of the Board Professionals.  The applicant shall demolish and remove the two rear dwellings, wood deck and shed prior to signing of map.  The applicant shall build new residence within footprint.  The applicant shall install two paved driveways on the common lot line.  Bulk variance is approved.

 

Chairman Braun made a comment stating the applicant has agreed to build a home fully conforming to this Board.

 

Deputy Mayor Thomson seconded the motion which was unanimously approved by a roll call vote.  (Ms. Wilson, Messrs. Thomson, Brosnan, Farrell, Luttman, Morris, Rible, Tobia and Braun voted yes.)

Mr. Feist gave his credentials which were accepted by the Board.

 

Mr. Feist explained the site is 1.98 acres and is located in the GI-2 zone.  The applicant is proposing the construction of a 23,000 s.f. building.  Mr. Feist said the site is served by a regional Stormwater facility.  The runoff will be directed to the existing detention basin.  Mr. Feist said parking will conform to township regulations but he felt the number of spaces is too high for this type of business.

 

Mr. Feist stated the applicant makes modeling clay.  It is mixed on site and then sent back out.  Mr. Feist said they employ 15 people.  They do not generally have visitors to the site.  There is just the delivery of material and the loading of the finished product for shipping.  Employee parking will be limited to the south side of the building.  Deliveries and outgoing shipments will be made on the north side of the building. 

 

Attorney Sonnenblick asked Mr. Feist if the applicant was moving his business here for larger quarters.  Mr. Feist said yes. 

 

Mr. Feist explained they are proposing 26.7% building coverage where 20% is permitted.  The total impervious coverage will be 60% where 65% is permitted. 

 

Mr. Feist explained the existing building to the north encroaches onto this property.  The result is this piece comes up just shy of two acres.

 

Attorney Sonnenblick asked when approval was given for the building to the north.  Mr. Feist said back in the 1980’s.  He said they have a copy of the former application and site plan that was approved.  Attorney Sonnenblick asked what the site plan showed.  Mr. Feist said 1.98 acres.

 

Attorney Sonnenblick asked about the waiver.  Mr. Feist said they are seeking a waiver because the curb radii have less than 5’.  Mr. Gerken said he had no objections to this waiver.

 

Mr. Feist explained the waiver for lighting.  He said a waiver was needed because of spillage across the property line.  Mr. Gerken said he had no objections to this waiver.

Attorney Sonnenblick asked Mr. Feist to explain how many trucks would be on site.  Mr. Feist said the applicant anticipates three trucks will visit the site per day.  One truck will deliver materials and the other two will ship the finished product.  He said the size of the trucks will vary.  He also stated tractor trailers will visit the site.  Chairman Braun asked how the tractor trailers would utilize the site.  Mr. Feist explained a 40’ trailer will enter the site by driving into the northwest corner of the property and back into one of the four loading bays.  He said a truck larger than 40’ would have to back into the site. 

 

Attorney Rubino asked for some ideas as to the frequency of larger trucks.  Mr. Feist said there may be three trucks backing in on the same day.  He said Industrial Road is not a through street and there is very little traffic. 

 

Chairman Braun asked if there was enough room for the backing in of tractor trailers.  Mr. Gerken said yes and he has no objections.

 

Chairman Braun asked about the dumpsters.  Mr. Feist said right now there is a dumpster at the rear of the property.  It does not belong to the applicant.  Attorney Rubino said it will be a condition of approval to ask the neighbor to move it. 

 

Captain Morris asked if there would be any storage of tractor trailers on site.  Mr. Feist said no.  He said the trucks are not owned by the applicant.   He said overnight parking will not be an issue.

 

Captain Morris asked about the hours of operation. 

 

John North, who has owned Chavant for two years, said the company has been in business for 110 years.  He has owned it for two years.  The hours of operation will be 8:00 A.M. – 4:00 P.M. and there will be no storage of trucks on site. 

 

Captain Morris asked if they would hold any training classes.  Mr. North said no. 

 

Captain Morris asked how many employees will be on site.  Mr. North said 15. 

 

Mr. Tobia asked about storage of materials.  Mr. North said everything will be stored inside.  Mr. Tobia said that will be a condition of approval. 

 

Mr. Thomas said he has visited the site.  He said the property is 1.98 acres.  The building will be to the north and there is vacant land to the south.  He said it is one of the largest lots on Industrial Road.  He said this building will be consistent with the area.

 

Attorney Sonnenblick asked about the site.  Mr. Thomas said there will be 15 employees.  He said even with the banking of parking spaces there are still 47 spaces proposed.  He said additional spaces can be banked.  Mr. Thomas said the type of building being proposed is not going to over utilize the site.  He said when the building is done there will be more green area than required.

Attorney Sonnenblick asked if the site being 1.9 acres was a problem.  Mr. Thomas said no the property backs up to a gravel operation.  He said this building will not impact anything. 

 

Mr. Tobia said he recommends banking the parking spaces in the front so there is more green area along Industrial Road.  Attorney Sonnenblick said that would not be a problem.

 

Mr. Thomas said the area in front of the building will be graded and trees will be planted. 

 

The application was open and closed to the public.

 

Mr. Tobia moved to approve the application for site plan subject to payment of taxes and applicable assessments.  The applicant shall comply with the review letters of the Board Professionals.  The applicant will comply with review letters from Wall Township Police Department, Wall Township Fire Commissioners letter and Wall Township Environmental Advisory Committee.  The applicant will comply with the requirements of Freehold Soil Conservation District, Monmouth County Board of Health and Monmouth County Planning Board.  Waivers and variances are granted as requested.  24 parking spaces will be banked for a total of 64 spaces.  They will be banked at the front of the building.  The applicant shall install a Knox Box system.  The applicant shall submit application for Subtitle 1 of Title 39.  The applicant shall schedule a pre-construction meeting with Wall Township Police Department.  There will be no outside storage.  The dumpster must be removed.  Any change in use must have Planning Board approval.  A meeting with Wall Township Police Department and emergency services must be scheduled prior to C.O. 

 

Attorney Sonnenblick said they can bank an additional 16 parking spaces.  Mr. Tobia said 24 is sufficient at this time. 

 

Deputy Mayor Thomson seconded the motion which was unanimously approved by a roll call vote.  (Messrs. Tobia, Thomson, Brosnan, Farrell, Luttman, Morris, Rible, Ms. Wilson and Mr. Braun voted yes.)

 

The Board recessed at 8:55 P.M.

 

The meeting resumed at 9:10 P.M.

 

Mr. Tobia and Captain Morris stepped down on the Gordon Wall application.

Attorney Gugliemo explained the applicant is proposing to construct a 30,000 s.f., one story office building and warehouse.  It will also be used for indoor maintenance for MONOC vehicles.  The site is located at 4806 Megill Road.  It is in the OP-2 zone.  The proposed use is permitted.

Attorney Gugliemo explained the applicant is seeking two variances, one to permit a smaller loading zone and the other to allow light spillage across the property line.

 

Mr. Robbins explained MONOC is now based in Eatontown.  They plan to use the proposed building as its new headquarters. 

 

Mr. Robbins said the hours are Monday thru Friday, 8:00 A.M. – 6:00 P.M.  There will be approximately 70 employees.  He said a dispatch service will also be out of the proposed building.  This will run 24 hours a day, seven days a week.  He said the dispatch service will require

between four and seven employees. 

 

Attorney Gugliemo asked about maintenance.  Mr. Robbins said minor maintenance will take place inside the facility. 

 

Attorney Gugliemo asked about parking.  Mr. Robbins said there will be 20 – 25 vehicles parked at the site as an emergency fleet.  Chairman Braun asked how many vehicles will be stored inside and how many outside.  Mr. Robbins said there will be 20 outside and maybe up to six inside.

 

Rich Kenderian gave his credentials which were accepted by the Board.

 

Mr. Kenderian began by describing the lot and its conditions.  He said the property is 6.027 acres.  It is 400’ in depth and 500’ in width.  It is located at block 930, lot 45.  It is in the OP-2 zone.  The site fronts on Megill Road.  It is wooded.  He said it is located approximately 300’ southeast of the Route 34 intersection.  Mr. Kenderian said there is a moderately steep slope falling from 125’ at Megill Road to 101’ at the northeast corner. 

 

Mr. Kenderian said the applicant has applied for a permit from the DEP to fill the isolated wetlands in the center of the property.  He said there are additional wetlands along the northern property line.  He said the building will avoid the wetlands except for the outfall structure. 

 

Mr. Kenderian said this will not be an intense use of the site.  He said ordinance allows 65% impervious coverage and 34% is being proposed. 

 

Mr. Kenderian said the building will be one story.  He said the first floor is split into two levels to take advantage of the slope of the property so no retaining wall will be needed. 

 

Mr. Kenderian explained there will be a single main ingress and egress as far west as possible on Megill Road.  He said they will provide complete circulation around the building. 

 

Mr. Kenderian stated 125 parking stalls are being proposed.  He feels 125 is more than enough.  He said an additional 31 will be banked on the west side of the building.  He said MONOC does not anticipate ever needing those stalls. 

 

Mr. Kenderian said the trash enclosure will be at the northwest side of the property.  It will not be visible from Megill Road.  It will be buffered. 

 

Mr. Kenderian made a correction stating the applicant will bank 39 parking spaces not 31.  He said the parking spaces will be located along the west and east sides of the building.  Chairman Braun said it appears that if you put them to the west you might have to take down some additional trees.  Mr. Kenderian said very few.  He said he will go along with the Board regarding buffering.  He said they were asked to position the building as far from the residents as possible.  He said they will put additional plantings on the site.

 

Mr. Kenderian said when designing the lighting plan they considered the neighboring residences.

He sad the parking lot will have eleven 20’ tall, 250 watt fixtures.  He said they will be back shielded so light will not spill onto the adjoining properties.  There will also be several building mounted fixtures to light the sidewalks.

 

Mr. Kenderian described the landscape plan.  He said there will be 307 individual plantings. 

 

Mr. Kenderian said the applicant will maintain a high standard for drainage.  He said they will reduce the rate of run-off on site.  They will maintain water quality.  He said the site is fully wooded.  He said they are reducing the run-off by 58%, 63% for a ten year storm and 49.7% for a 25 year storm.  They will install NJDEP class swales. 

 

Mr. Gerken said part of the parking area has standing water.  Mr. Kenderian said he will meet with Mr. Gerken and revise the plans.

 

Mr. Kenderian said the light spillage variance relates to the lighting at the entrance driveway.  He said the lighting will spill onto Megill Road to ensure the driveway is visible to oncoming traffic. 

 

Chairman Braun asked about the right hand turn only out of the facility.  Mr. Kenderian said he does not feel a right turn only is a great idea.  He said they will just come out and go to the next building and turn around.  He said he does not see any reason for that.  He said they received conditional approval from DOT without the right hand turn only.

 

Ms. Wilson said the Wall Township Police Department letter of November 27, 2002, #4, states the ingress and egress site triangle be revisited because of the sweeping curve east of the facility on Megill Road.  She said it is a safety issue and should be considered.  Chairman Braun said the County has jurisdiction.

 

Deputy Mayor Thomson said he has concerns regarding parking.  He said if the building is converted for office use the site would need a total of 150 parking spaces.  Mr. Kenderian agreed to eliminate the banked parking spaces and construct all the spaces at once. 

 

Ms. Wilson had concerns regarding ambulances coming out of the site.  She said they do not accelerate as quick.  Mr. Kenderian said safety is of utmost importance to the applicant.  He said the vegetation at the driveway will be shaved back along the site triangle to ensure visibility.  Attorney Rubino said if the County wants to approve something we don’t have the jurisdiction to ask for something else.  Deputy Mayor Thomson said it is not our road.

 

Mr. Kenderian said no variance for signage is needed. 

 

Mr. Kenderian went over the loading zone requirements.  He said we are proposing three loading zones.  He said the loading zones are not large enough for anything larger than a single body truck.  He said no tractor trailers will make any deliveries to the site with the exception of delivery of the initial furniture. 

 

Mr. Rible asked about a stand by generator.  Mr. Kenderian said a stand by generator will be

located at the rear of the site as far away from the residents as possible.  He said the noise level will be approximately 65 decibels at the rear of the property line and far less at the front property line. 

 

The application was open to the public.

 

Frank Fine, Belmar Boulevard, Vice President of Fred McDowell Inc. was sworn.  Mr. Fine was concerned about oxygen stored on the property.  He said there is an active mining operation next door.  Mr. Robbins said the building has been designed to include a thick walled concrete room solely for oxygen storage.  He said oxygen storage methods are mandated by both state and federal regulations.  He said MONOC follows all.

 

Mr. Fine asked if there was a huge tank of oxygen.  Mr. Robbins said no.

 

Ms. Wilson asked if it was cascade.  Mr. Robbins said yes.  Ms. Wilson asked if they will be following all regulations.  Mr. Robbins said they will follow both federal and state regulations. 

 

Chairman Braun asked about mining on the adjacent property.  Mr. Gerken said some of the site is inactive and this project will have no impact. 

 

Mr. Fine asked if the building was located far enough from the property line because of the mining on the adjacent site.  Mr. Gerken said he is not familiar with any regulations pertaining to properties adjacent to mining operations.  He said mining businesses are subject to setback requirements.  He said he will research the ordinance.  Mr. Gerken said MONOC’s building is located more than 50’ from the property line and conforms to ordinance regulations. 

 

Sandra Lohnes, 4803 Megill Road, was sworn.  Ms. Lohnes said she lives directly across the street from the subject site.  She thanked the Board for taking so much care regarding buffering.  She is concerned about the HVAC on the roof.  Mr. Kenderian said the HVAC will be completely enclosed.  It will be set back from the parapet.  He said it will not be seen from the adjacent property.   

 

Ms. Lohnes said she is also concerned about traffic and sirens blaring in the middle of the night.  Mr. Robbins said no emergency vehicles will be stationed there for response.  He said if they need to respond to an emergency in the neighborhood they would exit onto Route 34.  Chairman Braun said if Ms. Lohnes does notice some problems she should call the Wall Township Police Department. 

 

The application was closed.

 

Mr. Kiley asked about the 20 – 25 emergency vehicles on site, do you keep them at one place.  Mr. Robbins said they will be at the rear of the building.

 

Ms. Wilson confirmed that there will not be any emergency response team coming out of this building.  Mr. Robbins said no.

Mr. Rible moved to approve the application subject to the following conditions.  The applicant will comply with the requirements of Freehold Soil Conservation District, Monmouth County Planning Board.  The applicant will obtain approval from DEP and DOT.  Taxes and applicable assessments are to be paid up to date.  The applicant will comply with Wall Township Affordable Housing Trust Fund and ADA requirements.  The applicant shall obtain a tree removal permit.  The applicant shall comply with review letters from the Board Professionals, Wall Township Environmental Advisory Committee and Wall Township Police Department (except for no right turn).  The applicant shall comply with review letters from Monmouth County Planning Board, Wall Township Fire Prevention and Wall Township Fire District.  Waivers are granted.  Applicant shall have one loading zone.  The applicant shall install a Knox Box system.  The applicant shall submit application for Subtitle 1 of title 39.  The applicant shall schedule a meeting with Wall Township Police Department and emergency personnel prior to C.O.  All landscaping shall be approved by Township Planner.  The applicant shall install a Police Department communication system. 

 

Chairman Braun said when Mr. Rible talked about the loading zones it should be three undersized loading zones.

 

Mr. Brosnan seconded the motion which was unanimously approved by a roll call vote.  (Messrs. Rible, Brosnan, Farrell, Kiley, Luttman, Thomson, Ms. Wilson and Mr. Braun voted yes.)

 

Deputy Mayor Thomson moved to adopt the West Belmar Redevelopment resolution.  Mr. Luttman seconded the motion, which was unanimously approved by a roll call vote.  (Messrs. Thomson, Luttman, Brosnan, Kiley, Rible, Tobia, Ms. Wilson and Mr. Braun voted yes.)

 

There being no further business to come before the Board, a motion was made, seconded and unanimously approved to adjourn the meeting at 10:08 P.M.
