MINUTES OF THE REGULAR MEETING
DECEMBER 18, 2002
The Regular
Meeting of the Wall Township Board of Adjustment was called to order by
Chairman Clayton at 7:45 P.M. Members
present were Vice Chairman DeSarno, Wilma Morrissey, Ralph Addonizio, Dominick
Cinelli, second alternate James Gray, Attorney Hirsch, Recording Secretary
Betty Schinestuhl, Planning Coordinator Roberta Lang, Engineer Glenn Gerken,
Planner Cheryl Bergalio and Reporter Arnone.
Attorney Hirsch
announced that all requirements under the Open Public Meetings Act had been
complied with for this meeting and read the purposes of the Board of
Adjustment.

explained they are proposing to remove the existing porch and replace it with a
garage and family room. They will
install new windows. He said they do
not have enough room on the side for the 10’ setback that is required. They are proposing 5’. He explained one of the surveys submitted show
the existing site and the one that is proposed.

they have an 11’ setback on one side and that will be reduced to 5’
setback.

asked what is on the side of the addition.
Mr. Shibla said there is a house.
He said their setback is also 5’ – 6’.
He said it sets on the property like his does. He said the front setback is the same.
Attorney Hirsch
asked what is on the other side. Mr.
Shibla said a house which is 10’ from the property line. He said that house is the same distance from
the road as his house.

Attorney Hirsch asked
if there was any type of fencing or natural buffer between Mr. Shibla’s home
and the home to the right. Mr. Shibla
said there is a row of trees and some small bushes. He said they will not be removed.
Attorney Hirsch
said your lot is undersized, are the adjoining lots the same. Mr. Shibla said the lot on the left is
10,000 s.f., the lot to the right is the same.
He said the lot to the right looks like it was subdivided.
Attorney Hirsch
asked if the porch was being taken down.
Mr. Shibla said yes.
Attorney Hirsch
stated the applicant is going to remove the driveway along the side of the
house and he is going to install a new driveway just in the front where the new
garage will be. Mr. Shibla said that is
correct.
Mrs. Morrissey
asked if Mr. Shibla was in the roofing and siding business. She asked if he was going to do the work
himself. Mr. Shibla said he will do
some of it himself.
Mrs. Morrissey
asked if the adjoining property owners had any objections. Mr. Shibla said no so far there have been no
objections.
Mrs. Morrissey
asked about landscaping. Mr. Shibla
said it will be similar to what there is there now and some additional.
Mrs. Morrissey
asked if the new driveway will be wider.
Mr. Shibla said about 4’.
Mrs. Morrissey
asked if the garage will be used for storage and asked what size will the
garage be. Mr. Shibla said there will
be some storage and it will be a 1½ car garage.
The application
was open and closed to the public.
Mr. Cinelli
moved to approve the application as presented.
Mrs. Morrissey seconded the motion.
Attorney Hirsch
said the engineer’s report shows a grading plan needs to be submitted. Mr. Gerken said that will be taken care at
building permit time.
The motion was
unanimously approved by a roll call vote.

Mr. Baker said
he is applying for an extension of time.
He said he gave everything to his attorney on time but he was unable to
present it to the town.

asked if he was requesting a 180 day extension. Mr. Baker said yes. He
said he now has everything together.
Attorney Hirsch
said on February 7, 2002 a minor subdivision was approved. He said the time to perfect that approval
was 90 days. He said the time expired
in August, 2002.
Mrs. Morrissey
asked why Mr. Baker’s attorney was not able to file the necessary documents on
time. Mr. Baker said he cannot answer
that. He said his attorney is not here
tonight. Mr. Gray asked if he was still
his attorney. Mr. Baker said no.
The application
was open and closed to the public.
Mr. Addonizio
moved to approve an extension for 180 days.
Attorney Hirsch
explained this extension has to be filed with the Monmouth County Clerks’
office. This extension will bring you
to around February 2003. This extension
starts when the last one expired.

Attorney San
Filippo stated the Board accepted Mr. Spalt’s credentials as an engineer at the
last meeting.
Mr. Spalt,
previously sworn, gave his credentials as a planner. Attorney San Filippo said he will not use Mr. Spalt as an expert
planner.
Mr. Spalt handed
the Board a reduced copy of A-4.
Attorney San
Filippo asked Mr. Spalt to outline the improvements that are being
proposed. Mr. Spalt said the project
has been reduced. There are now six
dispenser islands instead of ten. The
canopy is also being modified.
Mr. Spalt said
two 9 s.f. helios logos on the north and east faces of the canopy are being
proposed. He said the logos will face
traffic on Route 71 and also on 18th Avenue. These signs are for identification purposes.
Mr. Spalt said a
concrete mat will be constructed to surround the gas pumps. The dimensions of the mat will match those
of the canopy.
Mr. Spalt said
the free-standing signs will conform to township requirements. He said they will measure 49.37 s.f. They will be 15’ tall and be setback 10’
from the road. Mr. Spalt said he does
not see any negative impact because of the signs.
Mr. Spalt said
two kiosks for employees will be located under the canopy.
Mr. Spalt said
there will be access on 18th Avenue and Route 71. This was designed with County and NJDOT
requirements.
Mr. Spalt
explained the trash enclosure will be 10’ X 10’. It will match the color of the building. It will be located in the front yard.
Mr. Spalt
explained five new aerial lights will be installed on site. There will be one fixture at each of the two
driveways, one will be north of the store, the fourth will be to the south of
the canopy and the last will be along the Route 71 frontage. They will be designed to direct light downward.
Mr. Spalt said
there will be three underground, double-wall, fiberglass storage tanks. Each tank will hold 12,000 gallons for a
total of 36,000 gallons. They will be
located under an 8” thick concrete mat at the front of the property on Route
71.
Mr. Spalt said
there are 32 parking spaces proposed as required by ordinance, two will be
handicapped spaces. They will be
located along the front of the building.
Mr. Spalt said
automatic vacuum and air for filling tires will be located at the southeast
corner.

Mr. Spalt said a
BP Connect legend sign will be located over the entrance to the store. He said that sign was reduced. It will be 3 s.f. That was also reduced.
Mr. Spalt said
there is landscaping proposed throughout the site. He said there will be screen plantings along Camp Meeting Street
which is at the rear of the building.
Mr. Spalt said
the property is located in the HB-20 zone.
Attorney San
Filippo asked Mr. Spalt if a gas station was permitted in the HB-20 zone. Mr. Spalt said yes.

Filippo asked if Mr. Spalt reviewed the sections of the ordinance regarding gas
stations. Mr. Spalt said yes.
Attorney San
Filippo asked Mr. Spalt what way does the applicant comply with the
ordinance. Mr. Spalt said the applicant
complies with 13 out of 15 conditions.
He said the two conditions they do not comply with are the building is
located closer than 50’ from the property line. The setback is 28.5’ where 50’ is required. The other condition they do not comply with
is lot coverage. He said 10% is allowed
and the applicant is proposing 11.1%.
He said the 11.1% has been reduced from the original application.

Filippo asked about bulk standards. Mr.
Spalt said the applicant complies with 8 out of 10 standards. He said a 50’ setback is required from Camp
Meeting Street, 28.5’ is proposed. The
other standard the applicant does not comply with is the setback from 18th
Avenue.

Filippo asked about the setback for gas dispensers. Mr. Spalt said the required setback is 30’ and the applicant
complies.
Mr. Spalt stated
there will be no access to the site from Camp Meeting Street. The site will be screened. He said the applicant is treating the
property at Camp Meeting Street as a rear yard. He said there will be no access by either drivers or
pedestrians.

Filippo asked about the rear setback.
Mr. Spalt said 30’ is required and the applicant is proposing
28.5”. Mr. Spalt said this is an
unusual lot, it has three frontages.
Attorney San
Filippo asked Mr. Spalt if the public will be able to see this facility from Camp
Meeting Street. Mr. Spalt said they are
proposing extensive landscaping and screening.
They will not be able to see it.
Attorney San Filippo said this lot is large enough to accommodate the
use.
Mr. Spalt said
three signs are proposed to be mounted on the building. He said facing Route 71 there will be a BP
Connect legend sign over the entrance to the store. He said a 25 s.f. helios sign will be located on the northeast
corner of the building. He said the
signs will be internally illuminated.

there will be extensive plantings between Camp Meeting Street and the building
itself.
Attorney San
Fillippo asked Mr. Spalt to explain why the signs are designed the way they
are. Mr. Spalt said because they are
used for identification. Attorney San
Filippo asked if the applicant complied with the signage ordinance. Mr. Spalt said yes. The applicant is proposing 140 s.f. where
150 s.f. is allowed.
Mr. Spalt said
they are proposing 32 parking spaces.
Attorney San Filippo said 10 spaces per 1,000 s.f. of building is
required.
Attorney San
Filippo asked about the loading space.
Mr. Spalt said a loading space is not being proposed. He said they will only accept deliveries of
gas and the only other deliveries would be for the store. He said most of deliveries will be made by
step vans or panel trucks. He said they
can easily fit in a standard parking space.

Filippo asked Mr. Spalt to go over the review letter from Glenn Gerken dated
December 11, 2002. Attorney Hirsch
asked Mr. Spalt to just address the areas that the applicant cannot comply
with.
Mr. Spalt said
two building mounted lights on the north and south sides of the building are
being proposed. He said they are a
security feature. He said they could be
located on a pole but the building mounted fixtures are less intense and lower
in height.

Filippo asked Mr. Spalt to address the preliminary and final site plan.

Mr. Spalt said a
post and rail mesh fence is proposed around the detention basin. He said the fence will keep trash out of the
basin and keep anyone from climbing the fence.
The proposed fence is 48’.
Mr. Spalt said
the overall height of the canopy is 19’ to the top. The clearance will be 14’ 6”.
He said the height will accommodate a tractor trailer.
Mr. Spalt said
the applicant will comply with all Mr. Gerken’s suggestions under Utilities in
his letter of December 11, 2002.
Mr. Spalt said
numbers 2, 3 and 4 under Stormwater Management have already been done. Mr. Gerken agreed.
Mr. Spalt said he
has already addressed the items under Landscaping and Lighting.
Mr. Addonizio
said his concern is that the lighting plan looks like a space ship taking off. Mr. Spalt said they reduced the
wattage. Mr. Addonizio said it looks
like more lighting. He said Mr.

the actual number of fixtures was increased.
Mr. Spalt said the lighting is modest.
Mr. Addonizio
said what works on Route 1 in Edison definitely won’t work here in Wall.
Attorney San
Filippo asked Mr. Spalt if other service stations in Wall Township, along Route
35, have recessed fixtures. Mr. Spalt
said some do and some do not. Attorney
San Filippo asked what is the difference from the public’s view. Mr. Spalt said if they are recessed fixtures
you do not see the light source and there is less glare.
Mr. Spalt said
there are five pole lights 16’ in height and 400W being proposed. He said there will be one at each driveway,
one in the parking area, one at the south end of the canopy and one at Route 71. Mr. Spalt said the fixtures will direct forward. They direct light forward away from the
pole. He said this type of lighting
will keep the light away from Camp Meeting Street. He said this light does not spill over and it will not extend
across the street.
Attorney Hirsch
asked what the hours of the gas station will be. Attorney San Filippo said 24 hours a day, seven days a week.
Mr. Spalt said
this is a very safe design. It is very
appropriate.
Mr. Spalt said
they will comply with Mr. Rizzitello’s letter of August 20, 2002.
Mr. Spalt went
over Mr. Maczuga’s review letter of December 11, 2002.
Mr. Spalt said
there are five monitoring wells on the property. He said three of those will remain, two will be relocated. Attorney San Filippo said the environmental
history of this property was submitted.
He said he will obtain an NFA from DEP.
Mr. Spalt said
the vacuum will be located at the extreme southeast corner of the
property. Sidewalks will be put in
along Route 71.
Mr. Spalt said a
rendering of the building and canopy will be provided.
Mr. Spalt said
they will comply with all of the items under Landscaping Plan.
Mr. Spalt said
they received an approval letter from Monmouth County Planning Board. He said they will resubmit new plans. He said DOT approval is pending. He said they will comply with the remaining
items under Recommendations.

Filippo said the canopy in the photo is similar to the one proposed in
Wall. Mr. Spalt said it is very
similar. He said this photo has the
same number of fixtures. He said the
free standing sign is to the right. He
said only the actual information is illuminated.
Mr. Addonizio
said at the last meeting there was testimony given regarding the strip at the
top of the canopy. He asked if that is
going to light up. Mr. Spalt said just
the light green strip.
Mr. Addonizio
said at the last meeting there was also testimony given regarding the signage
on the pumps. He said he did not see
any diagrams regarding this. He asked
Mr. Spalt to talk about that. Mr. Spalt
said he has a photo of the dispenser with signage.

asked if there would be any items sold at the pumps. Mr. Spalt said just gasoline.
Mr. Addonizio said he sees a Coke dispenser in the photo. Mr. Spalt said that is not proposed but it
would be up to the manager.
Mr. Addonizio
asked if the symbol on the pump was included in the total signage. Mr. Spalt said the signs on the pump were
not included in his calculations. He
said they could be eliminated. It is
not necessary.
Mr. Addonizio
said the whole pump is a sign. Attorney
San Filippo said most gas stations are color coded. He said he does not think the color should be considered signage. He said maybe the name but not the color.
Mr. Addonizio
said there are 12 logos and 12 Aamco signs.
Mr. Spalt said that is correct.
Mr. Addonizio
said there is a sign advertising bagels.
Mr. Addonizio said if this application is approved in the resolution it would state no selling or
advertising at the pumps.
Mr. Addonizio
asked what type of maintenance plan is proposed regarding the fence. He said every four or five years you have to
do something with them. Mr. Spalt said that
would be an operation issue. He said
they could use treated wood, PVC or vinyl.
Mr. Addonizio asked
if the fence could be seen from Camp Meeting Street. Mr. Spalt said it would be screened but you would be able to make
it out. Mr. Addonizio said on the plan there
is a portion of Camp Meeting Street that would not be screened. Mr. Spalt said they would continue to buffer
along Camp Meeting Street. Mr.
Addonizio said this is not estetically pleasing.
Mr. Addonizio
asked what kind of filters for oil and other debris is being proposed to keep
it out of the water supply. Mr. Spalt
said a filtration device will separate the debris and sediment. Mr. Addonizio asked where will the debris
and sediment go. Mr. Spalt said the
filtration device will

have to be
cleaned out every few months. He said
the applicant has a contract with a maintenance company. He said they are effective units. Mr. Addonizio asked how successful are they
at separating oil. Mr. Spalt said in
the high 80’s. He said this system is
the best thing around.
Mr. Addonizio
asked a question about safety. He said
he has seen on the television about the static electricity causing explosions
at gas stations. He asked what safety
measures has the applicant taken to avoid this. Mr. Spalt said New Jersey requires all gas stations to implement
vapor recovery systems. He explained
vapor is what ignites. He said when a
gas tank is filled the liquid displaces the vapor which when released into the
air ignites.
Mr. Addonizio asked
what type of food will be made at this store.
Mr. Spalt said some sandwich making.
They are not cooking. He said
the sandwiches will be like sandwiches from a deli. He said they will heat things in a microwave. There will be no ranges that require
venting.
Mr. Addonizio
asked how the mechanics will be shielded.
Mr. Spalt said they will be screened by metal panels. Mr. Addonizio said doesn’t metal echo. Mr. Spalt said it is more than a piece of
metal.
Mr. Addonizio
asked why BP thinks this is a good location.
He said there are five or so stations near by. Mr. Spalt said he is not qualified to answer that. He said it is on a highway and at a traffic
light.
Mr. Addonizio
asked about the tables inside the store.
Mr. Spalt said there will be three small high top tables with two stools
each.
Mr. Addonizio
asked if there would be any signage on the windows. Mr. Spalt said no.
Mr. Gray said
there are 32 parking spaces. There are
12 places to get gas and only three employees.
Mr. Spalt said there will be two – three employees inside and three
outside. He said there would be, maybe,
a total of six employees.
Mr. Gray said he
went to see the gas station on Route 1 in Edison. He asked if there are any others that are similar. Mr. Spalt said there is one on Route 130 in
New Brunswick. Mr. Gray asked if there
were any others. Mr. Spalt said
Jefferson Avenue in North Bergen.
Mrs. DeSarno
said there is an opening on Camp Meeting Street, why. Mr. Spalt said the applicant is putting a continuous buffer
there.
Mrs. DeSarno
asked about the circumference of the trees.
Mr. Spalt said 2½ - 3” at planting.
Mr. Gerken said
they are more than the minimum size required.
Mr. Addonizio
asked Mr. Gerken, regarding the trees they will be planting now, how many years
will it take for the back of the property to be shielded. Mr. Gerken said he did not know. He said deciduous trees are not going to
buffer anything, shrubs and evergreens will give good screening.

Mrs. Morrissey
asked about the Brinkerhoff report. She
said it states on three different dates 800 tons of soil was removed. Attorney San Filippo said the soil was
removed because it was contaminated. He
said DEP requires that it be backfilled with clean dirt.
Mrs. Morrissey
asked if DEP supplies CEA designation.
Attorney San Filippo said yes.
Brinkerhoff has to monitor those levels making sure they keep
decreasing. He said the levels have
come down because the contaminated soil has been removed. He said when DEP is satisfied that the
levels are below their standards then they will state no further action is
required.
The application
was open to the public.
Bill Hurley
stated he was not notified abut the meeting this time or last time. He said he is concerned about traffic. Attorney Hirsch said the applicant will be
producing a traffic engineer.
Mr. Hurley said
he is concerned about drainage. He said
they have problems now. He said there
are problems from the corner going to the stream toward Spring Lake. He asked how is it going to be
repaired. Mr. Spalt said DOT is
requiring the applicant to repair the drainage. Mr. Gerken said the State started to repair the drainage
problem. The work order stopped. They are reactivating the program. The State is going to repair it.
Mr. Hurley asked
if there would be an access on Elm Street.
Mr. Spalt said no.
Mr. Hurley asked
what is the distance from the driveway to Elm Street. Mr. Spalt said about 32’ from curb to curb.
Mr. Hurley asked
what the width of a tractor trailer is.
Mr. Spalt said 7½ - 8’ wide and 35’ – 60’ in length.

Filippo said a traffic expert is going to testify.
Margaret Chas,
1026 6th Avenue, asked how the gas station on Route 35, Wall and the
one on Main Street, Asbury Park compares to the one being proposed. Mr. Spalt said there are major
differences. Those gas stations were
pre-existing Amoco stations. They were
converted to BP stations. The one
proposed on Route 71 will be a state of the art facility. It will be a new structure. Ms. Chas asked if Mr. Spalt could compare
the size and lighting to the one on Route 35.
Mr. Spalt said it is smaller in size.
It is on a smaller lot. It is
located closer to the road.
Ms. Chas asked
about lighting. Mr. Spalt said the
lighting is generally similar.
Ms. Chas asked
Mr. Spalt if he was familiar with the station in Asbury Park. Mr. Spalt said no.
William Everett,
1815 Camp Meeting Street, asked about the fence on Camp Meeting Street. Mr. Spalt said there will be no fence on
Camp Meeting Street. Mr. Spalt said
there will be no access from Camp Meeting Street.
Mr. Everett
asked what type of fuel will the station pump.
Mr. Spalt said gasoline only.
Mr. Everett asked about diesel.
Mr. Spalt said no diesel.

Mr. Everett
asked if BP was going to assume responsibility for the underground storage
tanks for ongoing treatment such as filtering.
Mr. Spalt said yes, upon purchase of the property. He said at this point it is the property owners
responsibility. He said that would
transfer with ownership.
Linda Knust, 908
18th Avenue, asked what consideration was being given to her side of
18th Avenue. She said she
has heard quite a bit of testimony regarding Camp Meeting Street. She would like to know what they are going
to do to buffer the site from 18th Avenue. She said lighting will face the homes along 18th
Avenue. Mr. Spalt said a continuous
evergreen hedge will be planted near the parking area. Several shade trees will also be
planted. Mr. Spalt said as far as
lighting is concerned it will be directed away from 18th
Avenue.
Ms. Knust said
the station will be open 24 hours a day, seven days a week. She said the headlights will be aiming right
at her house. Mr. Spalt said that 18th
Avenue residents may see headlights as cars enter and leave the station.
William Johnson,
1801 Camp Meeting Street, stated his house is located right in the back of the
proposed gas station. Mr. Johnson said
he has a two story house. He asked if
he is looking out his rooms upstairs will he see the lights. He asked if the lights will be shining in
his windows. Mr. Spalt said they will
definitely not shine in the windows. He
said there is no lighting at the rear of the building. He said there will be extensive
buffering. Mr. Spalt said they have no
intention of lighting up Camp Meeting Street.
Mr. Johnson
asked where the dumpsters would be located.
Mr. Spalt said to the south of the building. Mr. Johnson asked how far would that be from his home. Mr. Spalt said he did not know. Mr. Spalt said the house at the southwest
corner is approximately 600’ from the trash enclosure. Mr. Johnson asked what would be going into
the dumpster. Mr. Spalt said cardboard,
paper wrappers, soda cans, etc. Mr.
Johnson said there could be an odor problem.
Mr. Spalt said it is unlikely due to the expected frequency of
pick-ups.
Mr. Johnson
asked if they would be leaving the trees on Camp Meeting Street. Mr. Spalt said yes and they are adding trees. Mr. Johnson said what about in the winter
time when the leaves fall. Mr. Spalt
said they would maintain a four season buffer.
Mr. Johnson asked how high the trees would be. Mr. Spalt said 6’ – 7’ at the time of planting. Mr. Johnson asked how long would it take for
them to grow taller than his house. Mr.
Spalt said they grow about 1’ a year.
Mr. Johnson
asked what direction would the vehicles be coming in off of Route 71. Mr. Spalt said they would be facing into the
site. Mr. Johnson said that would be in
the direction of his house. Mr. Spalt
said the headlights would never reach to Mr. Johnson’s house.

up. Is it going to be 5:00 A.M.? Mr. Spalt said pick-up will be arranged with
