MINUTES OF THE REGULAR MEETING

HELD IN THE MUNICIPAL MEETING ROOM

NOVEMBER 12, 2003

 

 

The Regular Meeting of the Wall Township Board of Adjustment was called to order by Chairman Clayton at 7:50 P.M.  Members present were Chairman Clayton, Vice Chairperson Mary DeSarno, Dominick Cinelli, Wilma Morrissey, Anthony Rembiszewski, Ralph Addonizio, Jim Gray, second alternate Wayne Palmer, Attorney Hirsch, Planning Coordinator Roberta Lang, Recording Secretary Betty Schinestuhl, Engineer Hoover and Reporter Arnone.

Attorney Hirsch announced that all requirements under the Open Public Meetings Act had been complied with for this meeting and read the purposes of the Board of Adjustment.

 

CARRIED APPLICATIONS

 

CASE #BA11-2003 – Date application complete: April 14, 2003

 

APPLICANT: MARTELLI DEVELOPMENT CORPORATION

 

PROPERTY: 1615 Highway 34, Block 917.01, Lot 19, OP-2 zone

 

RELIEF REQUESTED: Bulk/Use/Site

 

Attorney Hirsch reviewed the file and stated the Board had jurisdiction to proceed.

 

Chairman Clayton stated this application will be carried to December 17, 2003.

 

A person from the public asked how many times can this application be carried?  How many times can the application be changed?  Attorney Hirsch explained what happened.  The Board could dismiss the application without prejudice.  The Board will usually honor an adjournment if there is a good reason for it.

Mr. Casale explained the existing house is 20' X 30'.  The front of the house faces Bellewood.  It is a corner lot.  The house is one-story.  The house is 20’ from the street.  There is no basement.  There is a crawl space.  The addition will be the same height as the existing home. 

 

Attorney Hirsch asked what is on lot 41 on Glenn Street.  Mr. Casale said a single family home with a wooden deck.

 

Attorney Hirsch said if you are looking down Glenn Street is the house on lot 41 closer to the street.  Mr. Casale said it is closer by 4’ – 5’.  They also have a deck going closer to Glenn Street.  They have a second floor deck.  It extends about 10’ out.  Attorney Hirsch asked what is next to that.  Mr. Casale said there is a house that is about 8’ – 10’ from the street.  It is right on the property line. 

 

Attorney Hirsch asked if there was any natural buffering.  Mr. Casale said there are trees and bushes. 

 

Attorney Hirsch asked how far is the house on lot 41 from your property line.  Mr. Casale said about 6’.  Mr. Hoover said it is 10’. 

 

Mr. Addonizio said on the survey the addition meets up with the front and back.  Mr. Casale said it will be flush.  It will butt up against the existing house. 

 

Mr. Hoover asked what affect this will have on the neighboring resident.  Mr. Casale said really none.  He said he spoke with her and she has been encouraging.

 

Mrs. Morrissey asked if the shrubs will stay.  Mr. Casale said yes.

 

Mrs. Morrissey asked if the site distance would be blocked.  Mr. Casale said he is on a four way intersection.  You can only make a right onto Glenn.  No cars go up and down that street.

 

Mrs. Morrissey asked if Mr. Casale expected any drainage problems.  Mr. Casale said no.

Mr. Addonizio asked about the siding.  Mr. Casale said he will install new windows and new vinyl siding.  It will be light gray.

 

Mr. Addonizio asked if the front porch will be coming off.  Mr. Casale said he just redid the porch. 

 

Mr. Addonizio asked if Mr. Casale had any professional drawings.  Mr. Casale said no.

 

Mr. Addonizio said he has some concerns on how the addition will tie into the existing structure. 

 

Mr. Gray asked for the reason for the addition.  Mr. Casale said he has a one year old and his wife is pregnant.  It is very small inside.  He said he would like to stay in the neighborhood.

 

Chairman Clayton asked for the height of the addition.  Mr. Casale said about 15’. 

 

Chairman Clayton asked what is the distance from the house on lot 41 to your property line.  Mr. Casale said from my house to my property line is 11’.  From my fence to that house is about 6’ – 10’.  Mr. Hoover said that house is 10’ from the property line.

 

Attorney Hirsch asked about landscaping around the addition.  Mr. Casale said he will plant flowers, azaleas and something that blooms in the spring and fall along the house.

 

The application was open and closed to the public.

 

Mrs. Morrissey moved to approve the application subject to additional landscaping.  Mr. Addonizio seconded the motion which was unanimously approved by a roll call vote.  (Mrs. Morrissey, Messrs. Addonizio, Palmer, Gray, Rembiszewski, Mrs. DeSarno, Messrs. Cinelli and Clayton voted yes.)

 

Case #35-2003 – Date application complete: September 23, 2003

 

APPLICANT: JUDY & TOM KARL

 

PROPERTY: 1744 Howard Street, Block 67, Lot 4, R-10 zone 

 

RELIEF REQUESTED: Bulk variance 

 

Attorney Hirsch reviewed the file and stated the Board had jurisdiction to proceed.

Mrs. Karl said she just wants a screened in porch.  She said they are only over 4% of lot coverage.  There is nothing in the backyard now.  They just purchased the house in April 2003.  The house is about three years old.

Mr. Karl said the addition will be a season room.  It will just have screens.  They are going to build a deck to put the addition on.  There will be no glass.  It is pre-fab. 

 

Attorney Hirsch asked about the measurements.  Mr. Karl said it will be 13’ X 16’.  The room itself will be 12½' X 16’.

 

Attorney Hirsch asked what Mr. Karl thinks if the Board has problems with enclosing it with windows.  Mr. Karl said he does not have any plans for windows.  He said he would not do that.

 

Attorney Hirsch asked if the house was a two story dwelling.  Mr. Karl said yes.

 

Attorney Hirsch asked if there was a concrete driveway.  Mr. Karl said yes.

 

Attorney Hirsch asked if there were any other structures on the lot.  Mr. Karl said no just a fence.

 

Attorney Hirsch asked what is on lot 5.  Mr. Karl said a two-story house with a concrete driveway and deck.

 

Attorney Hirsch asked if lot 5 was larger than Mr. Karl’s.  Mr. Karl said it is a little bigger.  Attorney Hirsch asked for the size of lot 5.  Mr. Karl said 87’ X 45’. 

 

Attorney Hirsch asked about lot 3.  Mr. Karl said there is a two-story house with a garage and concrete driveway.  Attorney Hirsch asked if that lot was larger.  Mr. Karl said yes.

 

Attorney Hirsch asked for the size of Mr. Karl’s lot.  Mr. Karl said it is 58’ X 88’ X 90’. 

 

Attorney Hirsch asked about water coming off the house.  Mr. Karl said the gutters will go into the run-off and go underground to the retention basin. 

 

Mrs. DeSarno asked if there was any buffer at the rear property line.  Mr. Karl said there is a 6’ fence.  He said he did not want to do anything there until this was approved.

 

Mr. Gray asked what the reason for the size is.  He said it is rather large.  Mr. Karl said tt is manufactured according to panels. 

 

Mr. Gray asked if windows can be added later.  Mr. Karl said yes.

 

Chairman Clayton asked what the rear setback is.  Mr. Karl said 28’.

 

Chairman Clayton asked if lot 8 was the same.  Mr. Karl said there is 1’ between my fence and the property line.  Chairman Clayton asked how far it is to their house.  Mr. Karl said about 30’.

 

Chairman Clayton asked how far is the house on lot 5 from you.  Mr. Karl said there is 18’ between the houses.

 

Chairman Clayton asked if the houses were one or two stories.  Mr. Karl said they are all two stories.

Chairman Clayton asked Mr. Hoover if he had any concerns with run-off.  Mr. Hoover said no.  He said with the leaders going underground there should be no problems.

 

The application was open to the public.

 

Melissa Raksa, 1746 Howard Street, said the notice she received said the addition would be 16’ X 16’.  The application says 16’ X 12’.  Attorney Hirsch said it is 16’ X 12’. 

 

Ms. Raksa asked how high is the addition.  Mr. Karl said it will be 10’ and slopes down to 8’.

 

Ms. Raksa said the addition will be 13’ from the ground.  Mr. Karl said that is correct.

 

Ms. Raksa asked if Mr. Karl plans on addition a second floor.  Mr. Karl said no.

 

Melissa Raksa was sworn.  Ms. Raksa said her concern is about drainage.  She said she has an easement on her property.  It has had standing water in it.  She asked the Board that the water be adjoined to the leaders going underground.  Mr. Hoover said that was said. 

 

Mrs. DeSarno moved to approve the application subject to drainage concerns that were addressed.  Mr. Cinelli also added the condition that the room stay a three season room and have no windows.  Mr. Rembiszewski seconded the motion which was unanimously approved by a roll call vote.  (Mrs. DeSarno, Messrs. Rembiszewski, Palmer, Gray, Mrs. Morrissey, Messrs. Cinelli, Addonizio and Clayton voted yes.)

 

8:30 P.M. Mr. Cinelli left the meeting.

 

MINUTES TO BE ADOPTED:  Mrs. DeSarno moved to approve the minutes of the Workshop and Regular Meeting of September 17, 2003.  Mr. Gray seconded the motion which was unanimously approved.

There being no further business to come before the Board, a motion was made, seconded, and unanimously approved to adjourn the meeting at 8:45 P.M.
