MINUTES OF THE REGULAR MEET

HELD IN THE MUNICIPAL MEETING ROOM

JUNE 5, 2002

 

 

The Regular Meeting of the Wall Township Board of Adjustment was called to order by Chairman Clayton at 7:30 P.M.  Members present were Chairman Clayton, Dennis Noorigian, Dominick Cinelli, Anthony Rembiszewski, Wilma Morrissey, second alternate Jim Gray, Attorney Hirsch, Planning Coordinator Pam D’Andrea, Recording Secretary Betty Schinestuhl, Engineer Ray Savacool and Court Reporter Arnone.

 

Attorney Hirsch announced that all requirements under the Open Public Meetings Act had been complied with for this meeting and read the purposes of the Board of Adjustment.

 

Chairman Clayton announced the Richard Mueller application will be carried to June 19, 2002.

 

NEW APPLICATION

 

CASE #BA11-2002 – Date application complete:  March 25, 2002

 

APPLICANT:  JOHN AND RENEE BRINK

 

PROPERTY:  1113 New York Avenue, Block 299, Lot 14, 7.5 zone

 

RELIEF REQUESTED:  Bulk variance

 

Attorney Hirsch reviewed the file and stated the Board had jurisdiction to proceed.

 

John and Renee Brink were sworn.

Attorney Hirsch stated the Brink’s noticed for two variances, impervious and building coverage.  After a discussion Mr. Savacool said they do need the two variances. 

 

Attorney Hirsch went over Exhibit A-15.  He stated the home on lot 12 is 15’6” from the Brink’s common property line.  The home on lot 15.01 is 16’ from the common property line.  The house across the street, Lot 7, is 80’ from the Brink’s property line.  To the rear there is a house, Lot 7 that is 72’ 2” from the rear property.  He also stated the Brink’s home is 5’ from the property line.  Mr. Brink agreed.

 

Attorney Hirsch stated the lot is undersized.  He asked how large is the proposed addition going to be.  Mr. Brink said 7’ X 20’, approximately 945 s.f.  Mr. Savacool agreed.

 

Mr. Noorigian asked if the existing home is only one story.  Mrs. Brink said yes. 

 

Mr. Noorigian asked if they were proposing a second story.  Mrs. Brink said yes.

 

Mrs. Brink said they purchased their home in 1989.  It is a one bedroom home with a small closet. 

 

Mr. Noorigian asked if the Brinks’ were trying to conform to the rest of the neighborhood.  Mrs. Brink said yes.  She said the house was built in 1950.

 

Attorney Hirsch asked why was a variance needed.  Mr. Savacool explained because of the second story have a antilever. 

 

Mrs. Morrissey asked if the area over the garage was living space.  Mrs. Brink said no.

 

Mrs. Morrissey said there is a driveway on both sides of the Brinks’ home.  She asked if the neighbor had any objections to this addition.  Mrs. Brink said no.

 

Mrs. Morrissey asked about storm water run off.  Mr. Brink said it will go right to the ground.

 

Mrs. Morrissey asked about siding.  Mr. Brink said it will be similar to the garage.  It will have vinyl shingles on the lower half and vinyl siding on the rest. 

 

Attorney Hirsch asked if the cantilever is the only part increasing the coverage by 7½%.  Mr. Savacool said there is also a gravel driveway which is considered impervious coverage.  He said the driveway was included in that calculation

 

Mr. Cinelli asked about the height of the addition.  Mr. Brink said it will be about 29’.  Mr. Cinelli asked if that was code.  Mr. Savacool said code is 35’. 

 

Mrs. Morrissey asked if that is going to be the same height as the house to the east.  Mr. Brink said yes, it will not be any higher.

 

Chairman Clayton asked if the neighbor’s homes are set back the same as the Brinks’.  Mrs. Brink said their home is closer to the street.  Chairman Clayton asked if there were any homes in

the neighborhood that was close to the street like the Brinks.  Mr. Brink said yes, there is one two doors down.

 

Chairman Clayton asked if there were any other homes on 50’ X 100” lot.  Mr. Brink said there are some but most are on 100” X 100”.

 

Mrs. Morrissey asked what type of house was to the west of the Brink’s.  Mr. Brink said it was a small cape cod.

 

Mrs. Morrissey asked if the second floor addition would affect the lighting of the neighbor’s house.  Mr. Brink said no.

 

Mr. Savacool asked Mr. Brink to clarify the storm water run off.  Mr. Brink said his property slopes to the street.  He was going to put the down spouts facing the back.

 

The application was open and closed to the public.

 

Mr. Cinelli moved to approve the application subject to the applicant submitting a plot plan.  Mr. Rembiszewski seconded the motion, which was unanimously approved by a roll call vote.  (Messrs. Cinelli, Rembiszewski, Gray, Mrs. Morrissey, Messrs. Noorigian and Clayton voted yes.)

 

CASE #BA-15-2002 – Date application complete: May 15, 2001.  Carried from August 1, 2001, September 5, 2001, November 7, 2001, December 5, 2001, February 20, 2002 and April 17, 2002.

 

APPLICANT: CHRISTOPHER MECCIA

 

PROPERTY: 1640 Martin Road, Block 943, Lot 16, R-60 Zone

 

RELIEF REQUESTED: Bulk variance

 

Timothy B. Middleton, Esq. appeared for the applicant.

 

Attorney Hirsch stated this is not the first time the Board has heard this application.  The Board only took testimony once.  He stated the applicant has renoticed and it is acceptable.

 

The Board discussed what members were at the first meeting and what members were eligible to vote this evening.  Attorney Hirsch stated there are five members eligible to vote tonight.  Attorney Middleton stated his client would prefer a full quorum. 

 

Joseph Dochney, Esq. was in attendance representing an objector.  Edward Liston, Esq. was in attendance representing an objector.

 

Mr. Cinelli moved to grant the request to carry this application to September 18, 2002.  Mrs. Morrissey, Messrs. Noorigian, Rembiszewski, Gray and Clayton all agreed.

Attorney Hirsch suggested at the next meeting the applicant go over whatever testimony was given at the first meeting.  Attorney Middleton stated he is going to order transcripts.

 

Chairman Clayton said this application will be carried to September 18, 2002 and the first meeting in October if needed.

 

Attorney Hirsch stated no further noticing was required.

 

MINUTES TO BE ADOPTED:  Mr. Noorigian moved to approve the minutes of the study sessions and regular minutes of May 15, 2002.  Mr. Cinelli seconded the motion, which was unanimously approved.
