JANUARY 22, 2003

 

 

The Regular Meeting of the Wall Township Board of Adjustment was called to order by Chairman Clayton at 7:30 P.M.  Members present were Chairman Clayton, Vice Chairman DeSarno, Wilma Morrissey, Dominick Cinelli, Anthony Rembiszewski, James Gray, first alternate Robert Kerr, Attorney Hirsch, Planning Coordinator Roberta Lang, Recording Secretary Betty Schinestuhl, Engineer Glenn Gerken and Reporter Arnone.

Attorney Hirsch announced that all requirements under the Open Public Meetings Act had been complied with for this meeting and read the purposes of the Board of Adjustment.

 

NEW APPLICATIONS

Attorney Hirsch reviewed the file and stated the Board had jurisdiction to proceed.

Mr. Behringer said they are proposing a 30’ X 50’ pool house to be connected to the main house.  He said they enjoy swimming year round.  He said there is an error on the survey the height stated is 16’ it should be 17’.  Mr. Behringer said the walkway will be enclosed. 

 

Attorney Hirsch asked if the pool will meet all setback requirements.  Mr. Gerken said yes.

 

Attorney Hirsch said being the walkway is going to be enclosed is there a problem with building coverage.  Mr. Gerken asked Mr. Behringer if the garage was expanded.  Mr. Behringer said yes back in 1986.  Mr. Gerken asked if the garage was 26’ X 38’.  Mr. Behringer said yes.  Mr. Gerken said if all dimensions are correct he comes up with 4,390 s.f. which is 8.7% coverage and 9% is allowed.  He said it conforms.

 

Attorney Hirsch said they comply with building coverage so the only variance needed is for the pool house which is not an approved structure.  He said this type of structure is not addressed in the ordinance.  It is not a permitted structure so a bulk variance is required.

Attorney Hirsch asked if the pool house is going to be 167’ from the property line.  Mr. Behringer said yes.

 

Attorney Hirsch asked what was at the rear of the property.  Mr. Behringer said a residential lot with a house.

 

Attorney Hirsch asked how far that house from your rear line is.  Mr. Behringer said approximately 150’.  He said that lot is 600’ deep.

 

Attorney Hirsch asked if there was any natural buffering from your property line to the house in the rear.  Mr. Behringer said it is heavily wooded.  It is all natural terrain. 

 

Attorney Hirsch asked what was on the property to the north.  Mr. Behringer said there is a house on that property and they will be able to see the pool house. 

 

Attorney Hirsch asked how far that house is from the property line.  Mr. Behringer said approximately 28’ – 30’. 

 

Attorney Hirsch asked where is that house located in comparison to your house from the street.  Mr. Behringer said they are about the same.  It sits back maybe a few feet more from the road.

 

Attorney Hirsch asked if they had any structures in their rear yard.  Mr. Behringer said no.

 

Attorney Hirsch asked what was to the south.  Mr. Behringer said an existing house.  Attorney Hirsch asked how far from the property line.  Mr. Behringer said about 30’. 

 

Attorney Hirsch asked if there was any buffering to the north.  Mr. Behringer said no.

 

Attorney Hirsch asked if there was any buffering to the south.  Mr. Behringer said no.

 

Mrs. Morrissey asked if the residents on the pool house side had any objections.  Mr. Behringer said not that he is aware of.  He said he spoke to the neighbor and told him what he was doing and he said he had no objections. 

 

Mrs. Morrissey asked why the pool house is going to be 17’ high.  Mr. Behringer said because the terrain drops off.  Mrs. Morrissey asked why a 30’ walkway.  Mr. Behringer said he would like to use the pool as much as he can.

 

Mrs. Morrissey asked if there was any proposed landscaping.  Mr. Behringer said it is possible but he has nothing planned.

 

Mrs. Morrissey asked what the pool house is going to look like.  Mr. Behringer said the north side will have three windows.  The roof will have sky lights.  He said along the south side it will be all sliding glass doors. 

 

Mrs. Morrissey asked Mr. Gerken if there will be any grading problems.  Mr. Gerken said no problems.

Mr. Rembiszewski asked if the pool will be in the pool house.  Mr. Behringer said it will be an enclosed pool.  He said the pool will be inside the building.

 

Mr. Gray asked why 17’ high.  Mr. Behringer said because the building is 30’ wide, the pitch of the roof and because the building is the size it is.  He said the walls will be 9’ and then the roof.  He said the pool house will have the same shingles as the main house. 

 

Mr. Gray asked what color.  Mr. Behringer said the same as his house, red. 

 

Attorney Hirsch asked if there will be anything in the pool house.  Mr. Behringer said just the pool, heater and fiber optics for the pool.  There will be no shower, no air conditioning and no bathrooms. 

 

Attorney Hirsch asked if there would be a walkway around the pool.  Mr. Behringer said yes.

 

Chairman Clayton asked what the height of Mr. Behringer’s house was.  Mr. Behringer said it is the same height as the pool house.

 

Chairman Clayton asked if there would be a loft in the pool house.  Mr. Behringer said no.

 

Chairman Clayton asked if the pool house would have electric.  Mr. Behringer said yes.

 

Chairman Clayton asked if the pool house would have any sleeping quarters.  Mr. Behringer said no.

 

Attorney Hirsch asked if an architect designed the pool house or is it something Mr. Behringer has designed.  Mr. Behringer said he is designing it.  He said he has the plans already drawn up.  He said the building is 30’ X 50’ with cathedral ceilings.  It will be all cedar.  It will have six sky lights.  The south side will be all glass with sliding glass doors.  The inside will be sheet rocked.  He said it will be pretty much all glass.

 

Chairman Clayton asked if the walkway to the pool house is going to be open.  Mr. Behringer said it will be closed.

 

Chairman Clayton asked if it will be on a slab.  Mr. Behringer said no it will be on pavers. 

 

The application was open and closed to the public.

 

Mr. Rembiszewski moved to approve the application for bulk variance subject to additional landscaping around the pool house.  Mr. Gerken said the landscaping should be put closer to the property line.  Mr. Gray suggested putting landscaping on the north side.  Mr. Behringer said there is already buffering on the west side.  Mr. Rembiszewski said he revises the motion to planting some type of evergreens on the north and south property line and to the rear.  Mr.

 

Behringer said he has no objections on the north but on the south he does not think it would be very appropriate.  He said he feels it would look better if there was nothing on the south side.  Mr. Kerr suggested buffering along the walkway.

Jane Alwell, 1509 Wycoff Road, was sworn.  Ms. Alwell said she lives on the south side and she said she does not think anything is needed.  She said it will take away from the structure. 

 

Mrs. DeSarno asked Ms. Alwell what she sees now.  Ms. Alwell said because of the angle of the windows we are looking back toward the wooded area. 

 

Mr. Gray said plantings should be along the pool house on the north side only and along the walkway.  Mr. Gray seconded the motion, which was unanimously approved by a roll call vote.  (Messrs. Rembiszewski, Gray, Kerr, Ms. Morrissey, Mr. Cinelli, Mrs. DeSarno and Mr. Clayton voted yes.)

Attorney Hirsch reviewed the file and stated the Board had jurisdiction to proceed.

Mr. Quin said his house faces Belmar Boulevard.  Mr. Quin is proposing to remove the 4’ fence and replace it with a 6’ privacy fence.  He said he will landscape the Belmar Boulevard portion.

 

Attorney Hirsch asked if he was proposing a solid fence.  Mr. Quin said yes.

 

Attorney Hirsch asked if this property is a corner lot and has frontage on Belmar Boulevard and Washington Avenue.  Mr. Quin said yes.

 

Attorney Hirsch asked if variances were needed to install the pool.  Mr. Quin said it was there when he bought the house about three years ago.

 

Attorney Hirsch asked if the wood deck was also there.  Mr. Quin said yes.

 

Attorney Hirsch asked if Mr. Quin was proposing a 6’ fence where there isn’t one now.  Mr. Quin said there is a gravel driveway.  The fence will go from the corner of the house and pick up the existing fence and go down the side of the driveway. 

 

Attorney Hirsch asked if he was about 30’ from the street.  Mr. Gerken said in the low 20’s. 

 

Attorney Hirsch said the variance is for the 6’ fence where it encroaches into the front yard.  Fences are not permitted in front yards.  He said the variance is needed just for the fence on Belmar Boulevard.  The fence on the side is legal.

Attorney Hirsch asked what is on the side where the pool is.  Mr. Quin said a house.

 

Attorney Hirsch asked if that house faces Belmar Boulevard.  Mr. Quin said yes.

 

Attorney Hirsch asked if the setbacks were the same.  Mr. Quin said they setback a little more.

 

Attorney Hirsch asked where the driveway was on the neighboring house.  Mr. Quin said on the opposite side. 

 

Mrs. Morrissey said the property at 2913 would be the one affected by this fence.  She asked if they had any objections.  Mr. Quin said no they even offered to help pay for the fence.

 

Mrs. Morrissey asked if he was going to re-landscape.  Mr. Quin said yes.

 

Mrs. Morrissey asked if the fence would be similar to the one that is there now.  Mr. Quin said no it would be a white, solid, vinyl fence.

 

Mrs. DeSarno asked if there was landscaping done recently.  Mr. Quin said yes.

 

Attorney Hirsch asked Mr. Gerken if he had any problems.  Mr. Gerken said there is a sight problem now but it would not be a problem after the new fence is put up. 

 

Mr. Gerken said the fence at the back is on the neighbor’s property.  Mr. Quin said the new fence will be on my property line.

 

Mr. Cinelli asked if the fence would be on Mr. Quin’s property all the way to the back of the property.  Mr. Quin said yes.

 

Mr. Cinelli asked about the fence where the asphalt driveway is.  Mr. Quin said that belongs to the neighbor behind him.

 

Mr. Cinelli asked what is in front of that fence on your property.  Mr. Quin said nothing.

 

The application was open and closed to the public.

 

Mrs. DeSarno made a motion to approve the application as applied for.  Mrs. Morrissey seconded the motion which was unanimously approved by a roll call vote.  (Mesdames DeSarno, Morrissey and Messrs Kerr, Rembiszewski, Cinelli, Gray and Clayton voted yes.)

 

There being no further business to come before the Board, a motion was made, seconded, and unanimously approved to adjourn the meeting at 8:30 P.M.
